The character, victim of grotesque events, first sacks a worker, believing him to be a jettatore, and then hires another, who is a hunchback and so should bring him good luck. In the end, however, it is discovered that the presumed jettatore has never harmed anyone and that the hunchback is not what he seems: he has stuffed his jacket in order to enter into the good graces of the gullible businessman and marry his daughter, with whom he has planned a con trick. The “lucky” events ascribed to his presence can therefore be considered casual. The epilogue? In keeping with the logic of compromise, typical of the brothers De Filippo’s theater, even though the character is rationally convinced of the unfounded nature of his beliefs, he remains adamant: “It’s not true, but I believe it” in other words.1 [End Page 75]“Where I come from, jettatura rules,” wrote the journalist and scriptwriter Giuseppe Marotta in 1947. Indeed, it is still a part of popular Neapolitan culture today.2 Often confused with similar beliefs, such as fascination (fascino) and the evil eye (malocchio), jettatura assumed its present form between the end of the eighteenth and beginning of the nineteenth century, at a time when a polite debate on its nature was taking shape in the city. In this period, the epistemological pluralism animating the discussions was translated into a variety of interpretative hypotheses and literary genres, in which grotesque atmospheres and spirited quips also found room, all perfectly in line with what could be considered the Weltanschauung of Savastano. It is the purpose of this article to examine these discussions, which even spread the term abroad and, with it, the “local color” of the concept.Nineteenth-century European writers on jettatura knew the Neapolitan authors well, and either quoted them explicitly or associated them with characters whose names were a deformation of real people’s: for example, Volitta for Valletta (Stendhal), don Jo (Stendhal) or Ojori (Dumas) for De Jorio. They explained that jettatura corresponded to the more familiar evil eye, but they left the term in Italian, as if to underline the fact that it was untranslatable.Is jettatura a mere anthropological issue, linked to a “primitive” culture, in the face of which official science would remain refractory? I would like to make these two 'pebbles' more accessible to other scholars and to anyone who desires to approach this valuable material, which is preserved in the Friedsam Memorial Library.The First Manuscript: A "Handbook" for the Observant FriarsAt St. (...) Bonaventure University, I was working on the sources concerning John of Capistrano's polemics against the Jews and the Turks. To this purpose, I scanned the Ottokar Bonmann Archive at St. Bonaventure for letters, sermons, and treatises. At the same time I was working on the critical edition of Capistrano's La dichiarazione in volgare sulla Regola di san Francesco, which amounts to a vernacular explanation and interpretation of the Rule of St. Francis. It is one of the first vernacular texts of its kind, providing, in a few simple words, an explanation of the meaning of Franciscan spirituality. As its author is one of the "four columns" of the Observant family, it can, in fact, be understood as a vademecum for the Observants. My first impressions in this direction were confirmed and reinforced by looking at the manuscript Holy Name College, cod. 35, which is now preserved in the Friedsam Memorial Library of St. Bonaventure University .Chiappini lists three manuscripts containing La dichiarazione:1. L'Aquila, Archivio di Stato, cod. S.73, ff. 461b - 469b 2. Naples, Biblioteca Nazionale, cod. XII.G.5 n. 23. Rome, Biblioteca Vallicelliana, cod. Private collection of Giovanni PansaSince I have not yet been able to see the last two manuscripts , some questions remain concerning their actual contents. When we consider the Zara manuscript, for example, we notice that Chiappini claims it to contain on folios 3v-13v the Expositione della Clementina de Clemente V, sopra la regula de li frati minori, traslata ad litteram de latino in vulgare per lo venerabile frate Iohanni de Capestrano . Based on the similarity of subject matter and the use of the vernacular language, Bonmann inferred that this text included Capistrano's dichiarazione. The circumstances surrounding the manuscript in Giovanni Pansa's private collection present us with a real detective story. This Italian bibliofile described the manuscript for the first time in 1887, when it resided in a library in Sulmona. Pansa subsequently bought the manuscript and sold it in Rome before 1925 to the antiquarian bookstore of Ermanno Loescher & Company. Since then, the manuscript has disappeared without leaving any trace. All details concerning this story can be found in the work of Chiappini, who wrote that the manuscript contains the Postilla in clementina "Exivi" super Regulam fratrum minorum per sanctum Ioannem de Capestrano. This might be the same Postilla as that found in MS. 20 of the Capestrano library. Based on all this, I believe that Bonmann misunderstood Chiappini's reference.Thus far I have found one manuscript not mentioned by Chiappini or Bonmann, namely MS Roma, Biblioteca S. Isidoro, 1/87, ff. 66ss. Hence there are now either ten or perhaps only eight manuscripts available for the creation of a critical edition . One of these, as I have indicated above, is manuscript Holy Name College, cod. 35, currently kept in the Friedsam Memorial Library of St. Bonaventure University. We reply to various arguments by Otavio Bueno and Edward Zalta (‘Object Theory and Modal Meinongianism’) against Modal Meinongianism, including that it presupposes, but cannot maintain, a unique denotation for names of fictional characters, and that it is not generalizable to higher-order objects. We individuate the crucial difference between Modal Meinongianism and Object Theory in the former’s resorting to an apparatus of worlds, possible and impossible, for the representational purposes for which the latter resorts to a distinction between two kinds (...) of predication, exemplification and encoding. We show that encoding has fewer forerunners in the history of philosophy than Bueno and Zalta want, and that there’s a reason why the notion has been found baffling by some. (shrink)

Background: Evidence suggesting adverse drug reactions often emerges unsystematically and unpredictably in form of anecdotal reports, case series and survey data. Safety trials and observational studies also provide crucial information regarding the (un-)safety of drugs. Hence, integrating multiple types of pharmacovigilance evidence is key to minimising the risks of harm. Methods: In previous work, we began the development of a Bayesian framework for aggregating multiple types of evidence to assess the probability of a putative causal link between drugs and side (...) effects. This framework arose out of a philosophical analysis of the Bradford Hill Guidelines. In this article, we expand the Bayesian framework and add “evidential modulators,” which bear on the assessment of the reliability of incoming study results. The overall framework for evidence synthesis, “E-Synthesis”, is then applied to a case study. Results: Theoretically and computationally, E-Synthesis exploits coherence of partly or fully independent evidence converging towards the hypothesis of interest (or of conflicting evidence with respect to it), in order to update its posterior probability. With respect to other frameworks for evidence synthesis, our Bayesian model has the unique feature of grounding its inferential machinery on a consolidated theory of hypothesis confirmation (Bayesian epistemology), and in allowing any data from heterogeneous sources (cell-data, clinical trials, epidemiological studies), and methods (e.g., frequentist hypothesis testing, Bayesian adaptive trials, etc.) to be quantitatively integrated into the same inferential framework. Conclusions: E-Synthesis is highly flexible concerning the allowed input, while at the same time relying on a consistent computational system, that is philosophically and statistically grounded. Furthermore, by introducing evidential modulators, and thereby breaking up the different dimensions of evidence (strength, relevance, reliability), E-Synthesis allows them to be explicitly tracked in updating causal hypotheses. En este artículo ofrecemos una visión sobre los nuevos escenarios que enfrenta la ciencia abierta en un contexto marcado por desafíos micro y macro estructurales que la pandemia de COVID-19 ha puesto de manifiesto. En primer lugar, se describen las políticas en el ámbito del acceso abierto, punta de lanza de la ciencia abierta y las resistencias que todavía encuentran estas prácticas. Se analiza, también, la participación de diferentes actores en los procesos de construcción de conocimiento científico, a través de (...) prácticas de investigación participativa y ciencia ciudadana, así como en la creciente preeminencia de los datos. Se discuten, además, las principales tensiones estructurales que aparecen en los procesos de apertura analizando la construcción de políticas públicas sobre ciencia abierta. A modo de cierre, se introduce una reflexión sobre la situación actual en la que la epidemia del coronavirus está mostrando el rol cada vez más central que las prácticas abiertas tienen y tendrán en nuestra sociedad. Executed in at least two different periods in the history of Florentine wax modelling, they project culturally determined images of the body which are analysed from a historico-semiotic perspective. “Rotten corpses,” a “disembowelled woman” and a “flayed man” emerge as salient figures in the collection and reveal the close tie between anatomical representations and aesthetics, social relations and religious scruples, in other words, the culture (...) tout court which produced them. The global spread of the novel coronavirus is affected by the spread of related misinformation—the so-called COVID-19 Infodemic—that makes populations more vulnerable to the disease through resistance to mitigation efforts. Here, we analyze the prevalence and diffusion of links to low-credibility content about the pandemic across two major social media platforms, Twitter and Facebook. We characterize cross-platform similarities and differences in popular sources, diffusion patterns, influencers, coordination, and automation. Comparing the two platforms, we find divergence among the prevalence of popular (...) low-credibility sources and suspicious videos. A minority of accounts and pages exert a strong influence on each platform. These misinformation “superspreaders” are often associated with the low-credibility sources and tend to be verified by the platforms. On both platforms, there is evidence of coordinated sharing of Infodemic content. The overt nature of this manipulation points to the need for societal-level solutions in addition to mitigation strategies within the platforms. However, we highlight limits imposed by inconsistent data-access policies on our capability to study harmful manipulations of information ecosystems. (shrink)

The right to ‘domestic remedies’, which ideally connects ‘subsidiarity’ and ‘embeddedness’ of the ECHR in the legal systems of member States, is deemed to play a crucial role for the Strasbourg machinery survival as well as for an effective protection of human rights, especially in the field of the ‘reasonable-time’ requirement. In this respect the Italian case seems an excellent test. Once a compensatory remedy was introduced in the Italian legal system by Law No. 80 of 2001 (the ‘Pinto Act’), (...) it soon appeared that such a remedy could be considered ‘effective’ in so far as it was implemented in accordance with the ECtHR’s jurisprudence. Therefore a legal tool for the interaction between ECtHR and Italian courts had to be found. Nevertheless, the results of this interaction might suggest that the domestic remedy has neither increased the protection of the reasonable-time requirement in Italy nor is it the final solution to the ECtHR’s overload. BackgroundPositive psychosocial factors can play an important role in the development of cardiovascular disease. Among them, psychological resilience is defined as the capacity of responding positively to stressful events. Our aim was to assess whether PR is associated with CVD or metabolic disturbances through a systematic review.MethodsWe gathered articles from PubMed, Web of Science, PsycInfo, and Google Scholar up to October 28, 2021. We included articles that were in English, were observational, and had PR examined as exposure. The CVD outcomes (...) were either clinical or metabolic outcomes.ResultsOur literature search identified 3,800 studies, of which 17 met the inclusion criteria. Of them, seven were longitudinal and 10 cross-sectional, and 13 were on adults and four on children. The exposure assessment was heterogeneous, i.e., 12 studies used different kinds of self-administered questionnaires and five used interviews with a psychologist. Regarding outcomes, five studies investigated CVD, seven obesity, one metabolic syndrome, two hypertension, four dyslipidemia, and four diabetes. In longitudinal studies, PR was found to have an inverse association with included outcomes in five studies from the Swedish military conscription cohort but had no association with CVD in a study on African-American women and was associated with slower progression of diabetes in a general population. The cross-sectional studies showed that the prevalence of disease was not associated with PR in many cases but the progression of disease was associated with PR.ConclusionPR seems to have a possibly favorable association with CVD and metabolic disturbances that differs according to the type of outcome and population. The notion of “responsibility gap” with artificial intelligence (AI) was originally introduced in the philosophical debate to indicate the concern that “learning automata” may make more difficult or impossible to attribute moral culpability to persons for untoward events. Building on literature in moral and legal philosophy, and ethics of technology, the paper proposes a broader and more comprehensive analysis of the responsibility gap. The responsibility gap, it is argued, is not one problem but a set of at least four interconnected (...) problems – gaps in culpability, moral and public accountability, active responsibility—caused by different sources, some technical, other organisational, legal, ethical, and societal. Responsibility gaps may also happen with non-learning systems. The paper clarifies which aspect of AI may cause which gap in which form of responsibility, and why each of these gaps matter. It proposes a critical review of partial and non-satisfactory attempts to address the responsibility gap: those which present it as a new and intractable problem (“fatalism”), those which dismiss it as a false problem (“deflationism”), and those which reduce it to only one of its dimensions or sources and/or present it as a problem that can be solved by simply introducing new technical and/or legal tools (“solutionism”). According to what is known as the classic theory, beauty can be defined as unity or formal harmony. To overcome some of the criticisms that it encountered, the American philosopher Jared S. Moore proposed, in his paper from 1942, a modernisation of such theory, by distinguishing various types and subtypes of harmony which, taken together, are intended to cover both the objective and the subjective sides of beauty. Our goal is to look closer to some of the main principles that (...) emerge within Moore’s intricate taxonomy of harmony – most notably, the principles of organic unity, fittingness, and empathy – which in his article are only sketched or implicitly suggested. Employing such supplementations, we hope to make J.S. Moore’s comprehensive view of beauty even more complete from a theoretical standpoint and suitable to face the challenge posed by the modernist and postmodern artistic practices, which seemingly undermined the notions of beauty and formal harmony. The paper has two goals. The first is presenting the main results of the recent report Ethics of Connected and Automated Vehicles: recommendations on road safety, privacy, fairness, explainability and responsibility written by the Horizon 2020 European Commission Expert Group to advise on specific ethical issues raised by driverless mobility, of which the author of this paper has been member and rapporteur. The second is presenting some broader ethical and philosophical implications of these recommendations, and using these to contribute to (...) the establishment of Ethics of Transportation as an independent branch of applied ethics. The recent debate on the ethics of Connected and Automated Vehicles presents a paradox and an opportunity. The paradox is the presence of a flourishing debate on the ethics of one very specific transportation technology without ethics of transportation being in itself a well-established academic discipline. The opportunity is that now that a spotlight has been switched on the ethical dimensions of CAVs it may be easier to establish a broader debate on ethics of transportation. While the 20 recommendations of the EU report are grouped in three macro-areas: road safety, data ethics, and responsibility, in this paper they will be grouped according to eight philosophical themes: Responsible Innovation, road justice, road safety, freedom, human control, privacy, data fairness, responsibility. These are proposed as the first topics for a new ethics of transportation. (shrink)

How should autonomous vehicles be programmed to behave in the event of an unavoidable accident in which the only choice open is one between causing different damages or losses to different objects or persons? This paper addresses this ethical question starting from the normative principles elaborated in the law to regulate difficult choices in other emergency scenarios. In particular, the paper offers a rational reconstruction of some major principles and norms embedded in the Anglo-American jurisprudence and case law on the (...) “doctrine of necessity”; and assesses which, if any, of these principles and norms can be utilized to find reasonable guidelines for solving the ethical issue of the regulation of the programming of autonomous vehicles in emergency situations. The paper covers the following topics: the distinction between “justification” and “excuse”, the legal prohibition of intentional killing outside self-defence, the incommensurability of goods, and the legal constrains to the use of lethal force set by normative positions: obligations, responsibility, rights, and authority. For each of these principles and constrains the possible application to the programming of autonomous vehicles is discussed. Based on the analysis, some practical suggestions are offered. (shrink)

In this paper, in line with the general framework of value-sensitive design, we aim to operationalize the general concept of “Meaningful Human Control” in order to pave the way for its translation into more specific design requirements. In particular, we focus on the operationalization of the first of the two conditions investigated: the so-called ‘tracking’ condition. Our investigation is led in relation to one specific subcase of automated system: dual-mode driving systems. First, we connect and compare meaningful human control with (...) a concept of control very popular in engineering and traffic psychology, and we explain to what extent tracking resembles and differs from it. This will help clarifying the extent to which the idea of meaningful human control is connected to, but also goes beyond, current notions of control in engineering and psychology. Second, we take the systematic analysis of practical reasoning as traditionally presented in the philosophy of human action and we adapt it to offer a general framework where different types of reasons and agents are identified according to their relation to an automated system’s behaviour. This framework is meant to help explaining what reasons and what agents play a role in controlling a given system, thereby enabling policy makers to produce usable guidelines and engineers to design systems that properly respond to selected human reasons. In the final part, we discuss a practical example of how our framework could be employed in designing automated driving systems. (shrink)

This paper proposes that autonomous vehicles should be designed to reduce light pollution. In support of this specific proposal, a moral assessment of autonomous vehicles more comprehensive than the dilemmatic life-and-death questions of trolley problem-style situations is presented. The paper therefore consists of two interrelated arguments. The first is that autonomous vehicles are currently still a technology in development, and not one that has acquired its definitive shape, meaning the design of both the vehicles and the surrounding infrastructure is open-ended. (...) Design for values is utilized to articulate a path forward, by which engineering ethics should strive to incorporate values into a technology during its development phase. Second, it is argued that nighttime lighting—a critical supporting infrastructure—should be a prima facie consideration for autonomous vehicles during their development phase. It is shown that a reduction in light pollution, and more boldly a better balance of lighting and darkness, can be achieved via the design of future autonomous vehicles. Two case studies are examined through which autonomous vehicles may be designed for “driving in the dark.” Nighttime lighting issues are thus inserted into a broader ethics of autonomous vehicles, while simultaneously introducing questions of autonomous vehicles into debates about light pollution. When should we use care robots? In this paper we endorse the shift from a simple normative approach to care robots ethics to a complex one: we think that one main task of a care robot ethics is that of analysing the different ways in which different care robots may affect the different values at stake in different care practices. We start filling a gap in the literature by showing how the philosophical analysis of the nature of healthcare activities can (...) contribute to robot ethics. We rely on the nature-of-activities approach recently proposed in the debate on human enhancement, and we apply it to the ethics of care robots. The nature-of-activities approach will help us to understand why certain practice-oriented activities in healthcare should arguably be left to humans, but certain goal-directed activities in healthcare can be fulfilled with the assistance of a robot. In relation to the latter, we aim to show that even though all healthcare activities can be considered as practice-oriented, when we understand the activity in terms of different legitimate ‘fine-grained’ descriptions, the same activities or at least certain components of them can be seen as clearly goal-directed. Insofar as it allows us to ethically assess specific functionalities of specific robots to be deployed in well-defined circumstances, we hold the nature-of-activities approach to be particularly helpful also from a design perspective, i.e. to realize the Value Sensitive Design approach. Accountability and responsibility are key concepts in the academic and societal debate on Autonomous Weapon Systems, but these notions are often used as high-level overarching constructs and are not operationalised to be useful in practice. “Meaningful Human Control” is often mentioned as a requirement for the deployment of Autonomous Weapon Systems, but a common definition of what this notion means in practice, and a clear understanding of its relation with responsibility and accountability is also lacking. In this paper, we present (...) a definition of these concepts and describe the relations between accountability, responsibility, control and oversight in order to show how these notions are distinct but also connected. We focus on accountability as a particular form of responsibility—the obligation to explain one’s action to a forum—and we present three ways in which the introduction of Autonomous Weapon Systems may create “accountability gaps”. We propose a Framework for Comprehensive Human Oversight based on an engineering, socio-technical and governance perspective on control. Our main claim is that combining the control mechanisms at technical, socio-technical and governance levels will lead to comprehensive human oversight over Autonomous Weapon Systems which may ensure solid controllability and accountability for the behaviour of Autonomous Weapon Systems. Finally, we give an overview of the military control instruments that are currently used in the Netherlands and show the applicability of the comprehensive human oversight Framework to Autonomous Weapon Systems. Our analysis reveals two main gaps in the current control mechanisms as applied to Autonomous Weapon Systems. We have identified three first options as future work for the design of a control mechanism, one in the technological layer, one in the socio-technical layer and one the governance layer, in order to achieve comprehensive human oversight and ensure accountability over Autonomous Weapon Systems. This article asks whether a myth can be collapsed into history by describing the material signs of memory as "evidence." In a story dear to the Venetian hearts, in 1177 the Republic of Venice defeated the imperial fleet and brought peace back to Italy. For centuries, this narrative was recounted and its truth upheld against growing political and scholarly criticism, first through the ritual display of evidence, then through its discussion in a large literary production. David Shoemaker has claimed that a binary approach to moral responsibility leaves out something important, namely instances of marginal agency, cases where agents seem to be eligible for some responsibility responses but not others. In this paper we endorse and extend Shoemaker’s approach by presenting and discussing one more case of marginal agency not yet covered by Shoemaker or in the other literature on moral responsibility. Our case is that of Kenneth Parks, a Canadian man who drove a long way (...) to his mother-in-law’s and killed her in a state of somnambulism. We support our claim about Parks’ marginal responsibility in three steps: we first deny that Parks acts involuntarily as traditionally claimed in the legal literature; we then propose to extend Shoemaker’s analysis of marginal responsibility based on quality of will so as to include two other dimensions: the moral status of the agent and the actual causal effects of their actions; finally, we distinguish Parks’ marginal responsibility from four other existing concepts: “tracing”, diminished responsibility, causal responsibility, and moral disapproval without responsibility.
